What is a HMO?

All HMO's are defined by section 254 of Housing Act 2004 and Housing Act 1985 s345(2) as "a house occupied by persons who do not form a single household" are subject to local inspection in relation to:

  • Overcrowding

  • Burnley Borough Council's HMO Standards

The Council adopted the standards for HMOs on the 25th April 2006 which apply to all HMOs other than self contained flats. These standards incorporate:
  • The Management of Houses in Multiple Occupation (England) Regulations 2006
  • The Licensing and Management of Houses in Multiple Occupation and Other Houses (Miscellaneous Provisions) (England) Regulations 2006.
  • Standards from the Chartered Institute of Environmental Health
  • Fire Precautions
It is the manager and occupiers responsibility to ensure these standards are met.
  • Fire Precaution

Appropriate fire precaution facilities and equipment must be provided of such type, number and location as considered necessary.

Where the HMO consists of three or more storeys joint inspections will be undertaken by the local authority and fire rescue authorities who will advise on the necessary fire precautions.
