The Council receives many complaints concerning accumulations of waste in the rear yards of unoccupied and occupied properties. We can use Section 80 of the Environmental Protection 1990 to deal with these complaints.
An officer will visit the property and if possible, search the waste to find any evidence to indicate who may have dumped the waste in the yard. If the property is occupied, the occupier will be issued with a 7 day incident ticket requesting the waste is cleared within 7 days. If the property is unoccupied, we will write to the owner requesting they clear the yard within 7 days. After 7 days, the officer will return to check whether the yard has been cleared, if not, a legal notice is served on the owner/occupier. If the owner/occupier fails to clear the waste following receipt of the legal notice, we may take further legal action including prosecution and will clear the waste in default.
